By accessing and using the Apaleo PMS platform and related services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Apaleo, governing your use of our comprehensive hotel management system.
If you do not agree with any part of these terms, you must discontinue use of our services immediately. Your continued use of the platform following any modifications to these terms constitutes acceptance of such changes.
2. Service Description
Apaleo PMS provides a cloud-based property management system designed to streamline hotel operations through advanced technology solutions. Our platform offers comprehensive tools for reservation management, guest services, revenue optimization, and operational efficiency enhancement.
Core Services Include:
- Real-time reservation and booking management
- Guest profile and preference tracking
- Revenue management and pricing optimization
- Housekeeping and maintenance coordination
- Financial reporting and analytics
- Integration with third-party hospitality services
3. User Responsibilities and Account Management
Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You must provide accurate, current, and complete information during registration and promptly update any changes to ensure continued service availability.
You agree to use the Apaleo PMS platform solely for legitimate business purposes related to hotel and hospitality management. Any unauthorized access, misuse of system resources, or attempts to compromise platform security will result in immediate account suspension and potential legal action.
Important Security Notice
Never share your login credentials with unauthorized personnel. Enable two-factor authentication when available and regularly review account activity for suspicious behavior.
4. Data Privacy and Protection
Apaleo is committed to protecting the privacy and security of all data processed through our platform. We implement industry-standard security measures, including encryption, access controls, and regular security audits to safeguard your information and that of your guests.
By using our services, you acknowledge that certain data may be stored and processed in accordance with our Privacy Policy. You retain ownership of your business data while granting us necessary permissions to provide our services effectively. We do not sell, rent, or share your data with third parties except as required for service delivery or legal compliance.
You are responsible for ensuring compliance with applicable data protection regulations, including GDPR, when collecting and processing guest information through our platform. Apaleo provides tools and features to support your compliance efforts, but ultimate responsibility remains with your organization.
5. Service Availability and Support
While we strive to maintain 99.9% uptime, Apaleo cannot guarantee uninterrupted service availability due to factors beyond our control, including internet connectivity issues, third-party service dependencies, and necessary maintenance activities. We provide advance notice of scheduled maintenance whenever possible.
Support Hours
24/7 technical support for critical issues, with standard business hours support for general inquiries and training requests.
Maintenance Windows
Scheduled maintenance typically occurs during low-traffic periods with minimum 48-hour advance notification to all users.
6. Intellectual Property Rights
All intellectual property rights in the Apaleo PMS platform, including software, documentation, trademarks, and proprietary methodologies, remain the exclusive property of Apaleo and its licensors. Users receive a limited, non-exclusive license to use the platform solely for their intended business purposes.
You may not reverse engineer, decompile, or attempt to extract source code from our platform. Any feedback, suggestions, or improvements you provide may be incorporated into our services without compensation or attribution, though we appreciate your contributions to platform enhancement.
7. Limitation of Liability
Apaleo's liability for any damages arising from the use of our services is limited to the amount paid by you for the services during the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption.
This limitation applies regardless of the legal theory under which damages are claimed and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for certain types of damages, so these limitations may not apply to you.
8. Termination and Account Closure
Either party may terminate this agreement with thirty days written notice. Upon termination, your access to the platform will cease, and you must export any data you wish to retain within the notice period. Apaleo will provide reasonable assistance with data export procedures.
We reserve the right to immediately suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose security risks to our platform or other users. In such cases, we will provide notice when legally permissible and practical.
9. Modifications to Terms
Apaleo reserves the right to modify these Terms of Service at any time to reflect changes in our services, legal requirements, or business practices. We will provide notice of material changes through email notification and platform announcements at least thirty days before implementation.
Your continued use of our services after the effective date of any modifications constitutes acceptance of the updated terms. If you disagree with any changes, you may terminate your account in accordance with the termination provisions outlined above.
10. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction where Apaleo is incorporated, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services will be resolved through binding arbitration.
Before initiating formal dispute resolution procedures, we encourage users to contact our support team to resolve issues amicably. Many concerns can be addressed through direct communication and collaborative problem-solving approaches.
